AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and A Royal Flush, Inc., doing business as A Royal Flush Plumbing (“Company”, “we”, “us”, or “our”), concerning your access to and use of the arfplumbing.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. Your continued use of the Site after the posting of revised Terms of Use means that you accept and agree to the changes.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or would subject us to any registration requirement. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws.

The Site is not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. You may not use the Site in any way that would cause us to violate such laws.

USER REPRESENTATIONS

By using the Site, you represent and warrant that:

USER GENERATED CONTRIBUTIONS

The Site does not currently offer public posting of user-generated content. If content submission is enabled in the future, any submissions must comply with applicable laws and these Terms. You retain ownership of your content, but grant us a non-exclusive license to use it in connection with the Site.

THIRD-PARTY WEBSITES AND SERVICES

The Site may contain links to third-party websites or services. We do not control or endorse such third parties and are not responsible for their content, practices, or services.

We use third-party service providers, including ClickSend, to facilitate SMS and electronic communications. We do not control and are not responsible for delivery failures, filtering, delays, or security practices of third-party providers.

SMS & TEXT MESSAGING TERMS

By providing your mobile phone number to A Royal Flush Plumbing, you expressly consent to receive SMS and MMS text messages, including appointment confirmations, scheduling notices, service updates, and transactional or informational messages. Messages may be sent using automated systems and delivered through third-party providers such as ClickSend.

Message frequency may vary. Standard message and data rates may apply depending on your carrier. We are not responsible for carrier charges.

You may opt out at any time by replying STOP to any message. You may receive one final confirmation message. For help, reply HELP or contact us at office@arfplumbing.com or 228-867-9944.

We do not guarantee message delivery or timeliness. SMS is not a secure communication method. Do not transmit sensitive personal, financial, or health information via text message.

Consent to receive SMS messages is not a condition of purchase.

SITE MANAGEMENT

We reserve the right to monitor the Site, restrict access, remove content, or take legal action to protect our rights and ensure proper operation of the Site.

PRIVACY POLICY

Your use of the Site is subject to our Privacy Policy, which is incorporated herein by reference. SMS messaging data may be processed by third-party providers solely for message delivery purposes.

The Site is hosted in the United States. By using the Site, you consent to the transfer and processing of your data in the United States.

TERM AND TERMINATION

These Terms remain in effect while you use the Site. We may terminate or suspend access at any time, without notice, for any reason.

MODIFICATIONS AND INTERRUPTIONS

We may modify or discontinue the Site at any time without notice. We are not liable for any interruption or unavailability.

GOVERNING LAW

These Terms of Use are governed by and construed in accordance with the laws of the State of Mississippi, without regard to conflict of law principles.

DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved informally. If unresolved, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, with arbitration taking place in Harrison County, Mississippi.

Class actions are waived. Claims must be brought within one (1) year of accrual.

DISCLAIMER

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED THE LESSER OF $1,000 OR THE AMOUNT PAID BY YOU TO US IN THE ONE (1) MONTH PRIOR TO THE CLAIM.

INDEMNIFICATION

You agree to indemnify and hold harmless A Royal Flush, Inc. from any claims arising from your use of the Site or violation of these Terms.

ELECTRONIC COMMUNICATIONS

You consent to receive electronic communications and agree that electronic records and signatures satisfy legal requirements.

MISCELLANEOUS

These Terms constitute the entire agreement between you and us. References to A Royal Flush Plumbing refer to the trade name of A Royal Flush, Inc.
